OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER, WIN OR CLAIM A SWEEPSTAKES PRIZE. VOID WHERE  PROHIBITED. INTERNET ACCESS REQUIRED. DATA RATES MAY APPLY IF USING A MOBILE DEVICE TO PARTICIPATE.  

SPONSOR AND ADMINISTRATOR: The Cap’n Crunch^® Pack Up + Go Crunchventure Sweepstakes (the “Sweepstakes”) is sponsored by The Quaker Oats Company (“Sponsor”), 433 W. Van Buren Street, Chicago, IL 60607, and is administered by Majestic Digital (“Administrator”), 205, 692 Queen St E, Toronto, ON.

1. SWEEPSTAKES PERIOD: The Sweepstakes begins on April 01, 2024, at 12:00:00 PM Eastern Time (“ET”) and ends on August 16, 2024, at 11:59:59 PM ET (“Sweepstakes Period”). Administrator’s clock shall be the official clock of the Sweepstakes. A “day” begins at 12:00 A.M. ET and ends at 11:59 P.M. ET during the Sweepstakes Period, with the first “day” of the Sweepstakes Period beginning at 12:00 P.M. ET and ending at 11:59 P.M. ET on April 01, 2024.

2. ELIGIBILITY: The Sweepstakes is open to legal United States residents residing in the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age and the age of majority in their state of primary residence (19 in NE and AL; 21 in MS) at the time of entry. Officers, directors, employees, representatives and agents of Sponsor, its parent company, subsidiaries, affiliates, advertising and promotion agencies (collectively, “Sweepstakes Entities”) and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to participate in the enter or win. All federal, state, and local laws apply. Void where prohibited or restricted by law.  

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions and interpretations, which are final and binding in all matters related to the Sweepstakes. Entrants will not be allowed to change their physical address or e-mail address once an entry is submitted.

3. HOW TO ENTER: You can enter via the following methods:

a. Purchase Entry: During the Sweepstakes Period, purchase any one (1) package of Cap’n Crunch^® Ready-To-Eat Cereal, Cap’n Crunch^® Treat Bars, or Cap’n Crunch^® Instant Oatmeal (a “Qualifying Purchase”). Take a photo of the receipt showing the Qualifying Purchase, store name and purchase date. Go to CapnCrunchventure.com (the “Website”) and follow the prompts and instructions to create an account (“Registration”), which will require providing your First & Last Name, valid Email Address, Mailing Address (P.O. Boxes are not eligible), Phone Number, Date of Birth and a password for future logins. Limit of one (1) account Registration per person/email address. After Registration is complete, follow the instructions for uploading your Qualifying Purchase receipt and choosing a Grand Prize Pool into which you would like your Entry to be placed (a “Purchase Entry”). Purchase Entries are subject to verification of valid Qualifying Purchase receipt. Verification may take up to seventy-two (72) hours. Limit one (1) Purchase Entry per account per day.

A Qualifying Purchase receipt may only be used once. One (1) entry per receipt regardless of the quantity of Qualifying Purchases shown in photo. Purchase Entries that appear to duplicate any other submitted entries, in Sponsor’s sole discretion, will be void and only the first Purchase Entry submitted (based on entry time/date) will be considered for the Sweepstakes. Each submission must be manually key stroked and/or manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these or related email addresses/IP addresses may be blocked. Additionally, use of multiple email addresses, phone numbers and/or mailing addresses, and/or the manipulation of such information, for the purpose of obtaining more than the stated number of entries and/or prizes, is prohibited and such persons will be disqualified, and all entries shall be deemed invalid and any prize won shall be forfeited, as determined in the sole discretion by the Sponsor. In the event of a dispute as to the identity of an entrant, entrant will be deemed the individual named on the email address from the account from which the Purchase Entry was submitted, and such individuals must meet all eligibility requirements set forth herein and otherwise comply with these Official Rules. In the event of non-compliance with any requirements specified herein, Purchase Entry will be void. Your submission of a Purchase Entry constitutes your representation of eligibility, consent to participate in Sweepstakes and consent for Sponsor to obtain, use, and transfer your name, address and other information for the purpose of Sweepstakes administration.

b. No-Purchase Entry: To enter without making a purchase, hand-write your complete name, valid email address, street address (P.O. Boxes not accepted), city, state, ZIP code, telephone number including area code, date of birth and name of preferred Prize Pool (found in the Prizes section below) on a 3”x5” postcard in a hand-addressed envelope with sufficient postage postmarked no later than 8/16/24 to: Cap’n Crunch^® Pack Up + Go Crunchventure Sweepstakes ENTRY, P.O. Box 536986, Orlando, FL 32853-6986.  All No-Purchase Entries must be postmarked no later than 8/16/24 and received by 8/23/24 to be eligible for the Drawing. No-Purchase Entry must be mailed separately in a hand-addressed, stamped envelope. No photocopied or mechanically reproduced No-Purchase Entries accepted. No responsibility is assumed by Sponsor and Sweepstakes Entities for lost, late, illegible, misdirected or postage-due No-Purchase Entries or mail. No-Purchase Entries will not be acknowledged or returned.

For the purpose of these Official Rules, Purchase Entries and No-Purchase Entries may be referred to herein each as an “entry” or collectively as “entries.” Limit of one (1) entry, regardless of entry method, per person/email address per day throughout Sweepstakes Period. Multiple entries per day from any person/email address will be void.

4. PRIZES: There are three (3) Grand Prize Pool Options from which entrants can choose to apply their entry. One (1) Grand Prize will be awarded per Prize Pool Option, as outlined below. Odds of winning a Grand Prize will depend on the number of eligible entries received in each Grand Prize Pool.

BEACH GRAND PRIZE POOL #1:

One (1) Beach Trip: Consists of one (1) $6,000 promo code from Pack Up + Go, redeemable for a 3-day, 2-night trip for winner and up to three (3) guests.  Trip includes:

• Round trip airfare for Winner and up to three (3) guests

Approximate Retail Value of Prize (“ARV”): $6,600.

Total ARV: The total ARV of all available Sweepstakes Prizes in the Sweepstakes is $19,800.

Grand Prize Conditions: A Pack Up + Go Account is required to redeem a Grand Prize Promo Code. Pack Up + Go Terms apply (https://www.packupgo.com/terms-of-use). Pack Up + Go Terms are limited by these Official Rules.  Winner will be provided a link via email with instructions for creating an account. To create an account, Winner will be required to provide their full name and email address. The winner will be asked to provide a credit card and billing address only if they choose trip options that exceed their $6,000 promo code value. Winner will be made aware of any additional costs prior to being charged.  Once an account is created, Winner can redeem their promo code while being logged onto their account. This includes completing a pre-trip survey. Pack Up + Go promo code must be redeemed (and trip booked) six (6) - eight (8) weeks prior to departure date and no later than 3/19/25. Grand Prize Trip must be taken between 10/12/24 and 4/30/25.  Failure to do so will result in the Grand Prize being forfeited in its entirety. Grand Prize Trips are for surprise destinations. The details of the trip will not be provided to the Winner until the day of departure. Winner will receive a Surprise Trip Envelope in the mail that includes all trip details, including the location, within one (1) week of their departure date. All trip locations will require air transportation, which is included in the value of the Trip. Winner and guest(s) will be unable to drive to any trip destination. Trip destination will be determined in part by Pack Up + Go team and Winner’s completion of the pre-trip survey. Some details of trip destination and itinerary will not be able to change without incurring changes to the value of the trip to accommodate the adjustments. Winner would be responsible for covering these additional costs. All costs and expenses not specifically included herein are solely the winner’s responsibility. If the total Promo Code value of $6,000 is not used in its entirety for the Trip budget, Winner will receive an e-Visa Gift Card with the remaining amount of the prize value, to be used while on the Trip. While redeeming the Promo Code, if Trip budget exceeds $6,000, Winner will be responsible for any costs exceeding this prize value, including any additional days booked and additional Trip costs incurred. Winner’s guests must complete a Liability/Publicity Release (where legal) prior to issuance of travel documents. Winner’s guests must be 18 years of age or older, or the parent or legal guardian of any guest under the age of 18 must be the Winner or one of the other Guests on the trip. Winner’s Guests, or the parent or legal guardian of the Winner’s Guests (if Guest is under 18 years of age) must complete a Liability/Publicity Release (where legal) prior to issuance of travel documents. Once travel documents are issued, neither travel arrangements nor guest(s) may be changed without the express approval of Sponsor which may be withheld for any reason whatsoever. Winner and guests must travel on the same itinerary and must have all necessary identification needed for air travel (e.g., a valid driver’s license or passport). Winner must accept Grand Prize as stated, or prize will be forfeited. Winner must have an Uber account (via Uber.com or the Uber app) to utilize the Uber vouchers.  Travel and accommodations subject to change. All expenses not outlined herein are solely the responsibility of each winner and his/her guests.  Sponsor assumes no responsibility for canceled, delayed, suspended or rescheduled prize-related activities (including, but not limited to airline flights) beyond its control. In the event the winner and/or one of his/her guests misses a scheduled airline flight (through no fault of Sponsor or due to force majeure), Sponsor will have no liability for any costs associated with changing or rebooking transportation. Please consult a tax advisor prior to accepting a Grand Prize and executing an Affidavit of Eligibility to ensure any tax implications that may affect the Winner are understood.

Limit of one (1) Grand Prize per valid account/household.

5. GRAND PRIZE DRAWING/WINNER NOTIFICATION: Three (3) Grand Prize potential winners will be selected in random drawings on or about 8/24/24. One (1) winner will be selected from each of the three (3) Grand Prize Pools from among all eligible entries received for each prize pool. Potential Grand Prize Winners will be notified via the phone number and/or by email address provided with their entry and will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited), an IRS Form W9 and any other requested documents within three (3) business days from the date of attempted notification, or the prize may be forfeited and awarded to an alternate winner, at the Sponsor’s sole and absolute discretion. If any potential winner is (i) disqualified, found to be ineligible or not in compliance with these Official Rules; (ii) declines to accept a prize; (iii) does not reply to notification as stated above; or, (iv) does not return the documents within the stated time frame, the prize may be forfeited and an alternate winner selected in a random drawing from among all remaining eligible entries, as determined by Sponsor in its sole discretion. Any portion of a prize not accepted by Winner will be forfeited. Winners shall be solely responsible for payment of any and all applicable federal, state, and local taxes for their prize won. Sponsor will issue an IRS Form 1099 for each winner of a prize with an ARV of $600 or more. Any difference between stated approximate value of prize and actual value of prize will not be awarded. All other costs and expenses not expressly set forth herein shall be solely each winner’s responsibility. Sponsor is not responsible for any undelivered e-mails, including without limitation, e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes e-mail, including any winner notification e-mail, to a spam or junk folder. Prizes that are unclaimed, unredeemed, or returned as undeliverable will not be awarded. Prizes are non-transferable and no prize substitution, exchange or cash equivalent will be allowed, except by Sponsor, who reserves the right to substitute a prize of equal or greater value in case of unavailability of the prize or force majeure, at Sponsor’s sole and absolute discretion. Sweepstakes Entities shall not be held responsible for any delays in awarding the prize for any reason. Prizes will only be awarded to winners with addresses in one of the fifty (50) United States or the District of Columbia.

6. LIMITATION OF LIABILITY: By participating in this Sweepstakes, entrants agree that the Sweepstakes Entities and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers and each their respective officers, directors, stockholders, employees, representatives, designees, agents, its parents and affiliates (“Released Parties”) are not responsible for: (i) lost, late, incomplete, stolen, misdirected, postage due or undeliverable e-mail notifications or postal mail; (ii) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (iii) garbled, corrupt or jumbled transmissions, service provider/network accessibility, availability or traffic congestion; (iv) any technical, mechanical, printing or typographical or other error; (v) the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information; (vi) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Sweepstakes; (vii) any injury or damage, whether personal or property, to entrants or to any person's computer related to or resulting from participating in the Sweepstakes and/or accepting a prize; and (viii) entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Official Rules. Further, the Sweepstakes Entities are not responsible for any unanswered or undeliverable winner notifications.

By participating in the Sweepstakes, each entrant agrees: (i) to be bound by these Official Rules, including entry requirements; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of their rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Sweepstakes; and (iii) to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the sweepstakes, including, but not limited to, any sweepstakes-related activity or element thereof, and the entrant’s entries, participation or inability to participate in the Sweepstakes; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by entrant.

If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend the Sweepstakes or proceed with the Sweepstakes, including the selection of a winner in a manner it deems fair and reasonable, including the selection of a winner from among eligible entries received prior to such cancellation, termination, modification or suspension. In no event will more prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more winners than are stated in these Official Rules, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor, such as by way of example and not by way of limitation, in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment, and Sponsor shall not have any further liability to any entrant in connection with the Sweepstakes. Sponsor may modify and amend these Official Rules as they appear online from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

7. DISPUTES: By participating, participants and winners agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or any prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal, state or local court located in Cook County, Illinois; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) to the extent allowed by applicable law, under no circumstances will participant or winners be permitted to obtain awards for, and participants and winners hereby waive all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants’ and winners’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of Illinois or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than Illinois.

9. PUBLICITY RIGHTS: By participating in this Sweepstakes, each entrant agrees to allow the Sponsor and Sponsor’s designee the perpetual right to use their name, address (city and state), biographical information, likeness, picture and other information and content provided in connection with the Sweepstakes for promotion, trade, commercial, advertising and publicity purposes in all media worldwide including, but not limited to, on television and the Internet, without notice, review or approval and without additional compensation, except where prohibited by law.

10. GENERAL: Any attempted form of participation in this Sweepstakes other than as described herein is void. Sponsor and Administrator reserve the right to disqualify any entrant found or suspected, in their sole and absolute discretion, to be tampering with the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of this Sweepstakes. Any attempted form of participation in this Sweepstakes other than as in these Official Rules is void. If it is discovered that a person has registered or attempted to register more than once using multiple phone numbers, e-mail addresses, residential addresses, multiple identities, IP addresses, use of proxy servers, or like methods, all of that person’s entries will be declared null and void and that person will not be awarded any prize that he/she/they might have been entitled to receive. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Sweepstakes will void any attempted participation affected by such methods and the disqualification of the individual utilizing the same. Entrants and/or potential winners may be required to provide proof of identification and eligibility as required by Sponsor or Administrator In the event of a dispute as to the identity of a winner, the winning entry will be declared made by the authorized account holder of the e-mail address submitted on the registration form associated with such entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution) that is responsible for assigning email addresses for the domain associated with the submitted email address. Each entrant may be required to show proof of being an authorized account holder. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. No entrant shall have the right to modify or amend these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any sweepstakes details contained in these Official Rules and sweepstakes details contained in any promotional materials (including but not limited to point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Sweepstakes as set forth in these Official Rules shall prevail.  

11. WINNER LIST: For a list of winners, interested individuals should mail a self-addressed stamped business envelope to: Winners’ List-Cap’n Crunch^® Pack Up + Go Crunchventure Sweepstakes, PO Box 536986, Orlando, FL 32853-6986. Winners’ List requests must be received no later than September 24, 2024.
